1. Agreement to terms

These Terms of Service ("Terms") govern your use of VICTORIA (the "App"). By downloading, installing, or using VICTORIA, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the App.

2. Eligibility

You must be at least 13 years old to use VICTORIA. If you are between 13 and 17, you may use the App only with the consent and supervision of a parent or legal guardian — that adult agrees to these Terms on your behalf and takes full responsibility for how the App is used. By using the App, you confirm that you meet this requirement.

3. Health, nutrition & medical disclaimer

VICTORIA is a personal tracking tool, not a medical device or a source of medical advice. It does not diagnose, treat, cure, or prevent any disease or health condition. Calorie and nutrition figures shown in the App — whether from the USDA database, a scanned label, or your own manual entry — are estimates and may be incomplete or inaccurate.

Always check a product's physical label for the most accurate information, especially for allergies or medical dietary restrictions. Consult a doctor or registered dietitian before making significant changes to your diet, starting a weight-management plan, or if you have a medical condition that affects what or how much you eat.

4. AI-extracted nutrition data

When you scan a nutrition label, the values shown are generated automatically by a third-party AI service reading the photo you provide. This process can make mistakes — a blurry photo, unusual label formatting, or a misread digit can all produce an inaccurate result. Always review the pre-filled values against the physical label before saving, and correct anything that looks wrong. VICTORIA is not responsible for decisions made based on inaccurate scanned or estimated data.

5. Your content

Everything you log in VICTORIA — food entries, photos, goals, weight — is yours. Because this data stays on your device, we don't claim any ownership or license over it, with one narrow exception: when you use label scanning, you grant us (and OpenAI, our AI processing provider) a limited, one-time license to process that specific photo solely to extract nutrition information and return it to you. We don't use it for any other purpose, and we don't retain it afterward — see our Privacy Policy for details.

6. Prohibited uses

You agree not to:

• Use VICTORIA for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract the source code of the App
• Interfere with or overload the scanning service or any backend the App relies on (for example, automated or bulk scanning unrelated to your own personal use)
• Use the App to process, submit, or scan images that aren't nutrition labels, or that contain content you don't have the right to submit

7. Subscriptions & billing

VICTORIA is a subscription app: it is free to download, and after onboarding it requires a subscription, which begins with a free trial, sold and billed entirely through the App Store using StoreKit. Your purchase, renewal, trial, and refund terms are governed by the Apple Media Services Terms. Subscriptions renew automatically unless cancelled at least 24 hours before the current period ends; you can manage or cancel your subscription any time in the Settings app on your iPhone. VICTORIA does not process payments itself and never sees your card details.

Refund requests. Refunds of App Store purchases are decided by Apple, not by us. If you ask Apple to refund a VICTORIA purchase, Apple may ask us for information to help it decide. By using VICTORIA, you agree that we may answer, through RevenueCat: we may tell Apple that you agreed to this, whether you received the subscription you paid for, and whether a free trial was offered before you were charged, and we may tell Apple whether we'd prefer the refund to be granted or declined. We share this only with Apple, only when you ask Apple for a refund, and only to help Apple decide that request. Apple makes the final decision. Our Privacy Policy explains this under "If you ask Apple for a refund."

8. Third-party services

VICTORIA relies on a small number of outside services to work: OpenAI for label scanning, the U.S. Department of Agriculture's FoodData Central database for food search, and the App Store for subscriptions, with RevenueCat checking whether your subscription is active, answering Apple's questions when you ask for a refund, and measuring which of our ads bring people to VICTORIA. Your use of these features is also subject to those providers' own terms, where applicable. See our Privacy Policy for how each is used.

9. Intellectual property

VICTORIA, its name, logo, and design are owned by us. Nothing in these Terms transfers any of that to you. You may not use our branding without permission.

10. Disclaimer of warranties

VICTORIA is provided "as is" and "as available," without warranties of any kind, express or implied — including, without limitation, that the App will be uninterrupted, error-free, or that any nutrition data (scanned, database, or otherwise) will be accurate.

11. Limitation of liability

To the fullest extent permitted by law, VICTORIA and its developer won't be liable for any indirect, incidental, or consequential damages arising from your use of the App. Our total liability for any claim relating to the App is limited to the greater of one hundred U.S. dollars (US $100) or the amount you paid us in the 12 months before the claim. Some places do not allow certain limitations of liability; where that applies to you, our liability is limited to the fullest extent the law permits.

12. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. If you live outside the United States, nothing in these Terms takes away any protection that the consumer laws of your country of residence give you and that cannot be waived by agreement.

13. Changes to these terms

We may update these Terms from time to time. If we do, we'll update the effective date at the top of this page. Continuing to use VICTORIA after a change means you accept the updated Terms.

14. Additional terms for App Store users

VICTORIA is distributed through the App Store, and Apple requires the following to be part of these Terms. In this section, "Apple" means Apple Inc.

• Who the agreement is with. These Terms are between you and VICTORIA LLC only, not with Apple. VICTORIA LLC, not Apple, is solely responsible for the App and its content.
• Scope of the licence. You are granted a non-transferable licence to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions; the App may also be accessed by other accounts associated with you through Family Sharing or volume purchasing.
• Maintenance and support. VICTORIA LLC is solely responsible for any maintenance and support of the App. Apple has no obligation whatsoever to furnish any maintenance or support services for it.
• Warranty. VICTORIA LLC is solely responsible for any product warranties, to the extent not effectively disclaimed in these Terms. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, that you paid for the App; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
• Product claims. VICTORIA LLC, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including product-liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims under consumer-protection, privacy or similar legislation.
• Intellectual property. If a third party claims that the App, or your possession and use of it, infringes its intellectual-property rights, VICTORIA LLC, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
• Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-party terms. You must comply with any applicable third-party terms of agreement when using the App — for example, your mobile data plan's terms.
• Apple as third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
