One thing was deliberately left out, not forgotten: a binding-arbitration / class-action-waiver clause, which both Cal AI and MyFitnessPal include. A badly drafted arbitration clause can be worse than none — some are thrown out entirely, and consumer arbitration clauses get real scrutiny under state law. This is the single item most worth an actual lawyer's time before adding.
These Terms of Service ("Terms") govern your use of VICTORIA (the "App"). By downloading, installing, or using VICTORIA, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the App.
You must be [minimum age — not yet decided] or older to use VICTORIA. By using the App, you confirm that you meet this requirement.
VICTORIA is a personal tracking tool, not a medical device or a source of medical advice. It does not diagnose, treat, cure, or prevent any disease or health condition. Calorie and nutrition figures shown in the App — whether from the USDA database, a scanned label, or your own manual entry — are estimates and may be incomplete or inaccurate.
Always check a product's physical label for the most accurate information, especially for allergies or medical dietary restrictions. Consult a doctor or registered dietitian before making significant changes to your diet, starting a weight-management plan, or if you have a medical condition that affects what or how much you eat.
When you scan a nutrition label, the values shown are generated automatically by a third-party AI service reading the photo you provide. This process can make mistakes — a blurry photo, unusual label formatting, or a misread digit can all produce an inaccurate result. Always review the pre-filled values against the physical label before saving, and correct anything that looks wrong. VICTORIA is not responsible for decisions made based on inaccurate scanned or estimated data.
Everything you log in VICTORIA — food entries, photos, goals, weight — is yours. Because this data stays on your device, we don't claim any ownership or license over it, with one narrow exception: when you use label scanning, you grant us (and our AI processing partner) a limited, one-time license to process that specific photo solely to extract nutrition information and return it to you. We don't use it for any other purpose, and we don't retain it afterward — see our Privacy Policy for details.

VICTORIA offers an optional subscription with a free trial, sold and billed entirely through the Apple App Store using StoreKit. Your purchase, renewal, trial, and refund terms are governed by Apple's own Media Services Terms. Subscriptions renew automatically unless cancelled at least 24 hours before the current period ends; you can manage or cancel your subscription any time in your iPhone's Settings app. VICTORIA does not process payments itself and never sees your card details.
VICTORIA relies on a small number of outside services to work: an AI provider for label scanning, the U.S. Department of Agriculture's FoodData Central database for food search, and Apple's App Store for subscriptions. Your use of these features is also subject to those providers' own terms, where applicable. See our Privacy Policy for how each is used.
VICTORIA, its name, logo, and design are owned by us. Nothing in these Terms transfers any of that to you. You may not use our branding without permission.
VICTORIA is provided "as is" and "as available," without warranties of any kind, express or implied — including, without limitation, that the App will be uninterrupted, error-free, or that any nutrition data (scanned, database, or otherwise) will be accurate.
To the fullest extent permitted by law, VICTORIA and its developer won't be liable for any indirect, incidental, or consequential damages arising from your use of the App. Our total liability for any claim relating to the App is limited to the greater of [$X placeholder — not yet a reviewed figure] or the amount you paid us in the 12 months before the claim.
These Terms are governed by the laws of [state/country — not yet filled in], without regard to conflict-of-law principles.
